1. Acceptance of terms
By using groomcoffee.site or booking services with Motion Grooming and Coffee Inc., you agree to these Terms of Service. If you do not agree, please do not use the site or our services. A signed project agreement or proposal takes priority over these terms where they conflict.
2. Services
Motion Grooming and Coffee provides brand identity design, graphic design, commercial photography, product photography and short form video. The specific deliverables, timeline, revision rounds and usage rights for each project are set out in your written proposal or package description.
3. Quotes, booking and payment
- Quotes are valid for 30 days.
- A 50% non refundable deposit is required to reserve a shoot date or design slot.
- The remaining balance is due upon delivery of final files unless otherwise agreed in writing.
- Monthly plans are billed in advance at the start of each billing month.
- Invoices unpaid after 15 days may incur a late fee of 1.5% per month, or the maximum allowed by law if lower.
- Final files may be held until payment is received in full.
4. Client responsibilities
You agree to provide accurate information, timely feedback, access to locations, and any products, brand assets or approvals needed. You confirm you have the rights to any materials you provide to us, and that any people you bring to a session have agreed to be photographed.
5. Revisions and approvals
Design packages include the number of revision rounds stated. Additional rounds or changes outside the approved brief are billed at our current rates. Approval of a final design or gallery means it is accepted as complete.
6. Rescheduling and cancellation
Rescheduling and cancellation terms are described in our Refund & Cancellation Policy, which forms part of these terms.
7. Intellectual property and licensing
Motion Grooming and Coffee retains copyright in all photographs, video and preliminary design concepts unless otherwise agreed in writing. Upon full payment, you receive the license described in your package and in our Image Licensing terms. For brand identity projects, ownership of the final approved logo transfers to you upon full payment; unused concepts remain the property of Motion Grooming and Coffee.
8. Portfolio use
Unless you opt out in writing before the project begins, Motion Grooming and Coffee may display project work in its portfolio, website and social media pages.
9. Website use
You agree not to misuse the site, attempt unauthorized access, copy or download our images without permission, or use the site for unlawful purposes. Site content is provided as is and may change without notice.
10. Limitation of liability
To the maximum extent permitted by law, Motion Grooming and Coffee's total liability for any claim relating to a project is limited to the amount you paid for that project. We are not liable for indirect, incidental or consequential damages. If we are unable to complete a shoot due to illness, emergency, equipment failure or events beyond our control, our liability is limited to rescheduling or a refund of amounts paid for the affected service.
11. Indemnification
You agree to indemnify Motion Grooming and Coffee against claims arising from materials you supplied, your use of deliverables outside the granted license, or your breach of these terms.
12. Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state or federal courts located in Broward County, Florida.
13. Changes and contact
We may update these terms. Continued use of the site after changes means you accept them.
